On August 21, 1878, the American Bar Association (ABA) was founded as a professional association for lawyers. Legal advice is critical in developing comprehensive plans. Many post-disaster lawsuits focus on whether an entity or person took "reasonable care" to ensure the safety of people, property or the environment. This is often defined as the degree of care that a "reasonably prudent" person would use under like circumstances. By contrast, "negligence" is often defined as a failure to exercise or apply the degree of care appropriate to a situation.
